FTC Approves Amendments to ESRB’s COPPA Safe Harbor Program

In a letter to Entertainment Software Rating Board (“ESRB”) the Federal Trade Commission approved the ESRB’s application to modify its Commission-approved Children’s Online Privacy Protection Act (“COPPA”) safe harbor program. The approved amendments include an updated definition of “personal information and data” to include any information relating to an identified or identifiable individual collected online (e.g., cookies, IP addresses and geolocation), and the requirement for participants to submit a self-assessment questionnaire to the ESRB where there have been changes to products or a privacy statement.
