EU: Revised Draft of ePrivacy Regulation Released

On 21 February 2020, a revised text of the proposed Regulation concerning the Respect for Private Life and the Protection of Personal Data in Electronic Communications and Repealing Directive 2002/58/EC (Regulation on Privacy and Electronic Communications) (‘the Draft ePrivacy Regulation’) was released. In particular, the Draft ePrivacy Regulation introduces the possibility to process metadata for legitimate interests, as well as to use the processing and storage capabilities of terminal equipment, and to collect information from end-users’ terminal equipment when it is necessary for the purpose of the legitimate interests pursued by the service provider, except when such interest is overridden by the interests or fundamental rights and freedoms of the end-user.
